Age Discrimination Cases

In the past, age discrimination cases were virtually non-existent, however, with innovations in medicine and stretched salaries; many older workers are capable of working still and might actually have to be doing so. In essence, older workers are offered the same protections as other workers from discrimination in the workplace, including items such as hiring, firing, fringe benefits, promotions, salary, and job duties. In addition, a past practice of enforcing mandatory retirement ages is no longer legally valid, except in instances of higher executives, airline pilots, and law enforcement officers, among others. Likewise, older employees may qualify for protection not only under older workers laws, but also, via the Americans with Disabilities Act as well. Specifically, the Older Workers Benefit Protection Act prevent employers from discriminating against older workers in any way regarding benefits, such as healthcare coverage and retirement savings accounts.
