Employment Florida Law

Employment law in Florida presumes employees are at-will employees. An at-will employee can legally be fired at any time for any legal reason. Likewise, an employee can also quit at any time for any reason. If, however, an employee is working under a contract, they can normally be fired only if they violated a term of their contract. Florida employment law also provides employers the ability to have employees sign non-compete clauses, which state that the employee cannot work for a competitor for a set amount of time. As for a minimum wage, Florida law does not set one, but follows the federal guidelines. Florida law does require that an employer pays overtime once an employee has worked over 10 hours in one day. Florida law also provides for protection from anti-discrimination, and handles all such cases through the Florida Commission on Human Relations.
