Family Leave Law

There are times in a workers life when he/she must be out of work to care for either his/herself or a family member. Sometimes it is the worker who becomes sick and unable to go to work. Other times, it is a sick or disabled child that needs to be cared for. Other eligible family members under Family Leave Law include: parents and spouses. Many times, the absence of an employee can create a large burden for an employer because work is not getting done while he/she is out. Family Leave Law protects the employee's position while he/she is out. Under Family Leave Law, the employer must allow the employee time away without replacing them.

  • Family Leave Law states that an employer must provide an employee up to 12 weeks of unpaid leave in a 12 month period if he/she needs it.
  • Some eligible leaves covered under Family Leave Law include: childbirth and child care after giving birth, placement of children with the employee as a result of foster care or adoption.
  • Care of an immediate family member as a result of sickness or a serious health condition. Medical leave for the employee his/herself if they become ill.
