Labor Law Breaks

Labor law on breaks, meals, and rest periods in the workplace is typically not a federal level issue. In fact, federal laws do not require employers to provide employees any meal or break periods at all. To compensate for this illogical proposition, almost all states offer workers protection to ensure their right to ample break periods, meal periods, and yes, even restroom break rights. In a society where time is money, some employers will cross the line on maximizing employee production, which is where state laws provide workers with a reasonable level of support to meals, rest, and restroom breaks during set periods of working time. In addition, state laws often have widely varied laws regarding rest and meal breaks for minor workers as well. Check with your local and state laws to get an accurate depiction of your legal rights to breaks and meal periods before claiming foul with your employer. If a violation indeed is occurring, you can file a complaint with your state labor department.
