NJ Employment Law

The Department of Labor ("DOL") is a federal agency that enforces laws applicable to employers and employees. As a whole, the DOL enforces over 180 federal laws including the Fair Labor Standards Act ("FLSA") which regulates issues such as wages and work hours of employees. Many states, including NJ, have enacted their own labor laws to bolster the protections afforded by Federal regulations. NJ employment law is overseen by the State of New Jersey Department of Labor and Workforce Development which includes the Division of Wage and Hour Compliance ("DWHC"). The DWHC enforces NJ employment law that deals with conditions of employment and payment of wages. The primary function of the DWHC is to provide protections to NJ workers by investigating complaints and possible violations of the applicable employment laws.

Fast Facts

  • The State minimum wage in New Jersey is $7.15 per hour (effective July 24, 2009 the minimum wage in NY will increase to $7.25 per hour).
  • Under NJ employment law, independent contractors are not protected by the Division of Wage and Hour Compliance. If an independent contractor wants to file an employment claim, they must do so in the small claims court of the county where the employer is located.
