Ohio Work Health

The Occupational Safety and Health Administration ("OSHA") oversees workplace safety management through the implementation of the Occupational Safety and Health ("OSH") Act. Nearly all workplace safety management is governed by OSHA or OSHA-approved state programs. Both OSHA and OSHA-approved regulations apply to all public sector employers and all employers covered under the OSH Act. In addition to federal OSHA regulations, an Ohio work health initiative was passed in 2006 which prohibits smoking in all public areas and places of employment in Ohio. The Ohio work health law requires the Ohio Department of Health ("ODH") to enforce the legislation and further refine the rules. In an effort to gain the desired positive health impact for Ohio residents, the ODH expanded on the non-smoking rules. The ODH enforces the smoking-ban initiative by requiring business owners and individuals to post non-smoking signs and by implementing penalties and fines for violations of the law. The Ohio non-smoking laws and rules take precedence over any less restrictive local ordinances that may exist on the topic of smoking in public areas and workplaces.
