Pregnancy Leave Disability

The two major federal level pieces of legislation protecting the rights of expectant mothers in the workplace are The Pregnancy Act of 1978 and the Family and Medical Leave Act. Both acts provide expectant mothers pregnancy leave disability protection for set periods before and after their childbirth, the adoption of a new child, or the placement of a new foster child. In essence, pregnant women are provided the same insurance benefits, paid time off, and unpaid time off as workers with any medical illness or injury for companies with more than fifteen employees. In all cases, pregnant women cannot face discrimination or retaliation in the workplace, such as pay cuts, termination, or rejection during hiring and promotions due to their pregnancy status. According the EEOC, which handles claims of pregnancy discrimination, nearly six and a half percent of all claims were based on expectant or recently delivering mothers and their position in the workplace.
