Workplace Retaliation

Workplace retaliation is the act of an employer retaliating against an employee who is engaged in what is considered to be ムprotected' behavior. In other words, protected behavior may consist of: complaints in regards to safety of themselves or other employees, complaints regarding harassment, discrimination, or even retaliation against someone else, concerns regarding unpaid wages, testimonies given against the company regarding some kind of lawsuit by another employee or an outside party. These are but a few of the examples of protected behaviors. In regards to retaliation, it does not make a difference if the original complaint is proven to be valid or not. The act of retaliation in itself is prohibited on both a state and federal level. If an employee feels that they are being retaliated against by their employer, they may have ground for a lawsuit even if that retaliation has led to them no longer being employed by the company. In some of these cases, the retaliation even continues after the employee has been let go. This is considered the most serious kind of workplace retaliation.
