An employee is within their rights to file a wrongful termination suit if an employer discharges them for a reason that violates the legal rights of the individual. The U.S. Equal Employment Opportunity Commission ("EEOC") is the Federal body that enforces many of the laws that protect individuals from discriminatory employer practices that cause employees to be wrongfully terminated. One of the regulations that the EEOC enforces is the Age Discrimination in Employment Act of 1967 ("ADEA"), which focuses on providing protection to employees over 40 years of age. If an employer discharges an employee based solely on the employees age and without any other legal grounds for termination, that employee may have been wrongfully terminated. EEOC also enforces Title VII of the Civil Rights Act of 1964 which prohibits all employment discrimination based on race, color, religion, sex, or national origin. The 1964 Act makes it illegal for an employer to make hiring or termination decisions based on the religious beliefs, race, sex or national origin of an individual. If an employer discharges an employee based on one of the prohibited classifications, that employee has been wrongfully terminated and may file a wrongful termination suit with the EEOC.
