The short answer is no. The National Labor Relations Act, the federal law that regulates the relationship between unions and management, also protects employees' rights to form a union. An employer may not unfairly influence an employee's decision to join or form a union. An employer also may not use threats or other coercive tactics to influence the outcome of an election. Threatening to fire employees who want to form a union is illegal, plain and simple.
