The documents contained in your personnel file dictate whether you keep your job, the amount of the raise you receive, the impression a new supervisor has of you and the type of job reference you may receive in the future. With all of this important information, you should be able to review it, right?

Absent a company policy to the contrary, you have no right to review or to receive a copy of your personnel file that your employer keeps regarding your performance.  New Jersey and many other states have established that your personnel file is the property of your employer and have no right to the file.

There is an exception, though.  If you file a lawsuit against the company for harassment, discrimination, whistle-blowing, or another claim, you can receive ale te ccoopym of pyour personnel file.  The law allows you to review your personnel file in litigation because it is relevant to a legal claim against the company.
