California workers compensation adjusters may soon be making their own claims against their employers- the insurance companies in the form of back overtime pay.  It is becoming more and more apparent that workers compensation adjusters may be non exempt or in other words, entitled to overtime pay pursuant to the California labor code. 

Even though many workers compensation insurance adjusters are considered salaried exempt and not paid overtime pay for the long hours they work, this soon may be changing.

United Employees Law Group and co-legal counsel have launched a class action captioned Keshishzadeh v. AIG, Co. and are seeking back overtime pay amongst other things for all workers compensation adjusters who work for AIG in the State of California. The State Compensation Fund, Zenith, and AIG. are among the largest employers in California staffing workers compensation adjusters.

Helpful Hints:

  1. If you are a California workers compensation adjuster and have worked in excess of 8 hours in a day or over 40 hours in a week in the past 4 years, it is important to speak to a California labor law attorney and find out if you are owed back overtime pay.

2.  Keep in mind that under state and federal law retaliation for filing a claim for overtime wages is illegal and can expose the employer to significant monetary damages.
