Except in rare circumstances that involve high levels of discretion, or unless otherwise exempt, most California IT and Computer employees are non-exempt and entitled to overtime pay.

It is common for computer and software companies to label most computer and IT personnel salaried –exempt and work them long hours with no overtime pay.  The long terms effects of these abusive practices in such intense professions broken relationships, and significant health issues.

Many computer and software employees are now seeking assistance from California labor law attorneys who have on many occasions initiated a California overtime class action lawsuit against the employers.

Computer and software employees typically are entitled to overtime pay unless they exercise high levels of discretion such as hiring, firing, conducting performance reviews, and whose jobs require significant independent discretion. Typically, providing solutions or solving problems in which the answers are derived from well established protocol or manuals will not rise to required level of independent discretion to render an employee exempt and not entitled to overtime.

Helpful Hint: If you are working long hours without receiving overtime pay, it is wise to speak to a California labor law attorney who can carefully analyze your job duties and determine if you are entitled to back overtime pay. If this is the case, you could be in line for a very good pay day if the attorney is successful.
