According to Florida Child Labor Laws, this type of action is not legal. As long as a school day follows that day/night of work, your son’s work cannot legally make him work past 11p.m. and no longer than 8 hours that day. If it is during summer break or on a day where school is not in session the following day then he may work after 11p.m.
In your situation, either you or your son should bring this situation to the employer's attention. If the problem is not fixed, or if your son faces negative consequences for bringing this to the employer’s attention then you should contact a lawyer in your state that is familiar with labor and employment law. A lawyer will be able to counsel you on your rights, and help you present your case to a court of law.
